Las presentes Condiciones Generales de Contratación regulan la relación de prestación de servicios entre el Responsable y el usuario o cliente, de acuerdo con las estipulaciones legales, en especial la Ley 7/1998 sobre Condiciones Generales de Contratación, la Ley 3/2014 de Defensa de los Consumidores y Usuarios, el Reglamento (UE) 2016/679 (RGPD), la Ley Orgánica 3/2018 (LOPDGDD), la Ley 7/1996 de Ordenación del Comercio Minorista y la Ley 34/2002 de Servicios de la Sociedad de la Información.
El Responsable se reserva el derecho a realizar las modificaciones que considere oportunas, sin aviso previo, en las presentes Condiciones Generales. Dichas modificaciones serán de obligado cumplimiento durante el tiempo en que se encuentren publicadas en la web y hasta que no sean modificadas válidamente por otras posteriores.
El objeto de la página web es la prestación de servicios odontológicos. La duración del contrato quedará vinculada a la finalización del servicio contratado, sin perjuicio del derecho de desistimiento.
Como usuario o cliente declara expresamente conocer, entender y aceptar las condiciones de uso y estas condiciones generales de contratación. Del mismo modo, declara ser mayor de edad y tener la capacidad jurídica y de obrar necesarias para la contratación por medio de los mismos.
De conformidad con lo que establece el Reglamento (UE) 2016/679 y la Ley Orgánica 3/2018, el Responsable informa a los usuarios que los datos personales recabados durante el proceso de solicitud y contratación de servicios serán tratados bajo su responsabilidad, con la finalidad de tramitar dichas acciones y gestionar actuaciones posteriores derivadas de las mismas.

Los servicios ofertados, sus características esenciales y sus precios se detallan en la propia clínica y, en su caso, se comunicarán al paciente de forma clara y transparente en la primera visita, conforme al compromiso de presupuesto sin compromiso de la clínica.
Todos los precios incluyen, cuando sea aplicable, el Impuesto sobre el Valor Añadido (IVA) o indicarán expresamente si no lo incluyen.
El Responsable se reserva el derecho de retirar, reponer o cambiar los servicios que se ofrecen, mediante el simple cambio en el contenido de la web, sin perjuicio de los compromisos ya adquiridos con pacientes.
Todos los servicios ofrecidos gozan de la garantía correspondiente al tipo de servicio prestado. El Responsable dispone de un servicio de atención al paciente a través del teléfono 679 96 34 43 o del correo electrónico andreatorresdental@gmail.com, donde podrá dirigir la reclamación correspondiente en caso de disconformidad.
El cliente podrá abonar el importe de los servicios contratados mediante las formas de pago acordadas con la clínica. Todas las operaciones que impliquen la transmisión de datos bancarios se realizan utilizando entornos seguros.
El cliente dispondrá de un plazo de catorce (14) días naturales para desistir, a partir del día de celebración del contrato, sin penalización alguna y sin indicación de los motivos.

Según lo establecido en el artículo 103 de la Ley 3/2014, los suministros de servicios claramente personalizados o que, por su naturaleza, no puedan ser devueltos quedan exentos del derecho de desistimiento.
Si el cliente solicita que la prestación del servicio dé comienzo durante el periodo de desistimiento, quedará obligado al abono del importe proporcional a la parte del servicio prestada en el momento en que haya comunicado su desistimiento.
El reembolso de las cantidades recibidas se realizará utilizando los mismos medios de pago empleados por el cliente, salvo que se haya dispuesto lo contrario. El Responsable abonará las cantidades satisfechas antes de 14 días naturales desde la fecha de recepción de la comunicación de desistimiento.

El Responsable se reserva la facultad de presentar las acciones civiles o penales que considere oportunas por la utilización indebida de su sitio web y contenidos o por el incumplimiento de las presentes condiciones.
La relación entre el usuario y el prestador se regirá por la normativa vigente de aplicación en el territorio español. De surgir cualquier controversia, las partes podrán someter sus conflictos a arbitraje o acudir a la jurisdicción ordinaria, siendo el domicilio del Responsable C. The services on offer, their essential characteristics and their prices are detailed at the clinic itself and, where applicable, will be communicated to the patient clearly and transparently at the first visit, in line with the clinic's commitment to providing a no-obligation quote.
All prices include, where applicable, Value Added Tax (VAT) or will expressly state whether it is not included.
The Controller reserves the right to withdraw, restock or change the services on offer, by simply changing the website content, without prejudice to any commitments already made to patients.

The client may pay for contracted services by the payment methods agreed with the clinic. All transactions involving the transmission of bank details are carried out using secure environments.

The refund of amounts received shall be carried out using the same payment methods used by the client, unless otherwise agreed. The Controller shall pay the amounts received within 14 calendar days from the date of receipt of the withdrawal notification.
